Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Alayaaa website, applications and APIs (the “Service”) provided by Alayaaa (“Alayaaa”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a temple, maṭha, trust or other institution (an “Institution”), you represent that you are authorized to bind that Institution to these Terms.

1. The Service

Alayaaa helps Institutions manage devotee contacts and communication, collect donations and payments, offer sevā/darśana and event bookings, and keep simple accounts. Features may change, improve or be discontinued over time.

2. Accounts & eligibility

• You must provide accurate information and keep your account credentials secure.
• You are responsible for activity under your account and for your administrators’ use of the Service.
• You must be of legal age and capacity to enter into these Terms.

3. Your data & responsibilities

• You retain ownership of the contacts, content and records you upload (“Institution Data”). You grant Alayaaa the rights needed to host and process Institution Data to provide the Service.
• You are responsible for having a lawful basis and any required consent to upload devotee data and to send messages, and for complying with applicable law — including messaging consent/opt-in rules (e.g. WhatsApp Business Policy) and, for SMS in India, TRAI/DLT requirements.
• You will not use the Service to send unlawful, deceptive, or unsolicited bulk messages, or to harass or harm others.

4. Acceptable use

You agree not to:

• break the law or infringe others’ rights;
• interfere with or disrupt the Service, or attempt to gain unauthorized access;
• reverse engineer or resell the Service except as permitted by law;
• upload malware or misuse another person’s data.

5. Payments & fees

• Donations. Devotee donations are collected directly into the Institution’s own bank account via UPI. Alayaaa facilitates collection and reconciliation but is not a party to the donation and does not take custody of those funds.
• Subscription. Use of certain features may require a paid subscription. Fees, billing cycle and taxes are presented at sign-up or in the app. Unless stated otherwise, fees are non-refundable except as required by law.
• You authorize us and our payment processor to charge applicable fees to your selected payment method.

6. Third-party services

The Service integrates third-party services (for example Google, Meta/WhatsApp, SMS providers, hosting and payment processors). Your use of those integrations may also be subject to their terms. Where you connect Google Contacts, our use of that data is described in our Privacy Policy and complies with the Google API Services User Data Policy, including its Limited Use requirements.

7. Intellectual property

The Service, including its software, design and trademarks, is owned by Alayaaa and its licensors. These Terms do not grant you any right in our intellectual property except the limited right to use the Service.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that messages or payments will always be delivered or processed by third-party networks.

9. Limitation of liability

To the maximum extent permitted by law, Alayaaa will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue or goodwill. Our total liability for any claim relating to the Service will not exceed the amounts you paid to us for the Service in the three months before the event giving rise to the claim.

10. Indemnity

You agree to indemnify and hold Alayaaa harmless from claims arising out of your Institution Data, your messages, or your breach of these Terms or applicable law.

11. Suspension & termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or others. On termination, your right to use the Service ends; we will make Institution Data available for export for a reasonable period unless prohibited by law.

12. Governing law

These Terms are governed by the laws of India, and the courts at the place of Alayaaa’s principal operations will have exclusive jurisdiction, without regard to conflict-of-laws rules.

13. Changes

We may update these Terms from time to time. We will revise the “Last updated” date and, for material changes, provide additional notice where appropriate. Continued use after changes take effect means you accept the updated Terms.
